Lori Vallow Daybell's attorney in a motion filed this week is alleging "unethical and possible illegal activity, discussions, disclosures, and manipulation of the incompetent defendant."

Attorney Mark Means says Lori and who he believes is a state-issued clinician watched Chad Daybell's transfer of trial motion together.

"During this hearing (the clinician) recommended to defendant that she contact the Church of Jesus Christ of Latter-day Saints legal counsel to discuss her case and possibly obtain legal counsel to assist her instead of state appointed public defender," the motion states.

Means says the clinician provided Lori with the direct phone number to contact LDS church counsel and issued an "order" that this was part of the defendant's homework for treatment. The motion states that Lori reached out to church counsel and was connected with an attorney.

The attorney's office, in a statement to EastIdahoNews.com, said it told Daybell they could not provide her with advice or representation. Means is asking that the clinician be disqualified from treating her.

East Idaho News, received a statement from prosecutors.

“The State will continue to focus on pursuing justice on behalf of the victims. We will address the unfounded claims by one of Ms. Daybell’s defense attorneys in a court of law — not in the media,” the statement reads.

The state health department, when reached by CBS2, said, "DHW will follow standard procedures when there are allegations of possible employee misconduct. However, such investigations are confidential because they are an employee matter."
